1. Who we are
Hummingbird Bathrooms, Kitchens & Constructions Limited (“we”, “us”, “our”) is a limited company business operated by Karl Mottram, trading from 7 De Havilland Drive, Speke, Liverpool L24 8RN.
We are the data controller for the personal information described in this policy. That means we decide what information is collected and what happens to it.

2. What information we collect
When you contact us through the website
Our contact form asks for your first and last name and a telephone number, which are required, so that we can respond to your enquiry or quotation request. You can also, if you wish, give us your email address and tell us your preferred time for a callback, and there is a free text box for you to describe what you would like to discuss.
Anything you choose to type into that box is also collected. We do not ask for the address the work relates to at this stage; we normally take that when we arrange a survey.
When we visit your property
To prepare an accurate quotation, we usually need to survey the property. During a survey and while the work is being carried out, we may record measurements, notes about the condition and layout of the property, photographs of the areas we are working on, and details of existing services such as gas, water and electrics.
When you become a customer
We collect the information needed to carry out and invoice the work, including your billing address, payment details, correspondence with you, records of variations agreed, and certificates and test results produced during the job.
Information you volunteer about accessibility needs
Some customers tell us about a medical condition, disability or mobility requirement so that we can design a bathroom or access arrangement that suits them. This is health information and it receives extra protection under data protection law. We only record it where you have chosen to tell us, we only use it to design and carry out the work, and we do not use it for anything else.

3. Why we use your information, and our lawful basis
Under UK GDPR we must have a lawful basis for using your information. Ours are as follows.

Where we rely on consent you can withdraw it at any time by contacting us. Withdrawing consent does not affect
anything we did before you withdrew it.
4. Photographs of your property
We often photograph completed bathrooms, kitchens and building work. Photographs taken purely as a working record of the job are covered by the contract between us.
We will only use photographs publicly, for example on our website, in a portfolio or on social media, if you have agreed to it. We will ask you separately and you are free to say no. Saying no will not affect the work or the price in any way. We do not publish your name or address alongside photographs unless you have specifically agreed to that as well. If you change your mind later, tell us and we will remove the images from anything we control, although we cannot always recover images that others have already shared.
5. Who we share your information with
We do not sell your information to anyone. We share it only where we need to:
- Suppliers and merchants, where a delivery has to be made to your address or an item ordered to your specification
- Subcontractors and other trades we engage on your job, who are given only what they need to carry out their part of the work
- Gas Safe Register, a Part P competent person scheme, or your local authority building control, where the work has to be notified or certified
- Structural engineers, architects and surveyors, where the work requires their input
- Our accountant and bank, for invoicing, payment and tax purposes
- Our insurers and, if necessary, legal advisers, in the event of a claim or dispute
- Our website, email and IT providers, who host the systems the information sits in
Anyone acting as a processor on our behalf is required to keep your information secure and to use it only for the purposes we have specified.
We may also disclose information where we are legally required to do so, for example to HMRC, the Health and Safety Executive or a court.
6. Where your information is held
Your information is held on systems located in the UK or the European Economic Area, or with providers who offer equivalent protection under a UK adequacy decision or the International Data Transfer Agreement. If we ever need to move your information outside those arrangements, we will make sure appropriate safeguards are in place first.
7. How long we keep it

When a retention period ends, we securely delete or destroy the information.
8. Your rights
Under UK data protection law you have the right to:
- Be informed about how we use your information, which is what this policy is for
- Access a copy of the information we hold about you
- Rectification of anything that is inaccurate or incomplete
- Erasure of your information in certain circumstances
- Restrict processing in certain circumstances, so that we hold the information but do not use it
- Data portability, meaning you can ask for information you gave us in a machine-readable format
- Object to processing we carry out on the basis of legitimate interests, and to object to direct
marketing at any time - Withdraw consent where consent is the basis we rely on
To exercise any of these rights, contact us using the details in section 1. We will respond within one month. There is no charge unless a request is manifestly unfounded or excessive. We may ask you to confirm your identity before we release information.
9. Cookies and analytics
Our website uses a small number of cookies and analytics tools. A cookie is a small text file placed on your device when you visit a website. We use them only as described below.
Strictly necessary cookies
These are needed for the website to work properly and for the enquiry and quotation form to function. They are set automatically and do not require your consent.
Analytics cookies
We use Google Analytics to understand how visitors find and use our website, for example which pages are viewed and how people arrive at the site, so that we can improve it. Google Analytics sets the cookies listed below. In our configuration IP addresses are truncated, and we do not use the data to identify individual visitors.
These analytics cookies are only set if you accept them through the cookie banner shown when you first visit the site. You can change or withdraw your choice at any time using the cookie settings link at the foot of every page, or by blocking cookies in your browser. You can also install Google’s browser add-on to opt out of Google Analytics across all websites.

Google acts as our processor for analytics data and may process it outside the UK. Where that happens, it is covered by the safeguards described in section 6.
Google Search Console
We also use Google Search Console. This tool reports to us on how our website appears in Google search results, using data Google collects as part of its search service. It does not place cookies on your device and does not collect information that identifies you as an individual visitor to our site.
The enquiry and quotation form
The contact form on our website is used only to receive enquiries and quotation requests. Information you submit through it is handled as described in sections 2 and 3 of this policy. Submitting the form does not place advertising or tracking cookies on your device.
You can block or delete cookies through your browser settings at any time, although parts of the site may not work properly if you do.
10. Marketing
We will only send you marketing about our services if you have asked us to, or if you are an existing customer and the message relates to similar work. Every marketing message includes an unsubscribe option, and you can also ask us to stop at any time by contacting us directly.
11. Automated decision making
We do not use automated decision making or profiling that produces legal or similarly significant effects.
12. Children
Our services are aimed at property owners and occupiers, and our website is not directed at children. We do not knowingly collect information about children other than where a parent or guardian mentions household circumstances in the context of a job.
13. Complaints
If you are unhappy with how we have handled your information, please tell us first so that we have the chance to put it right. Contact us using the details in section 1.

We review this policy periodically and will update it when our practices or the law change. The date at the top shows when it was last revised. Where changes are significant, we will draw attention to them on the website.
